Your Credit Score: When to Stop Fighting the Rapids

“But won’t bankruptcy destroy my credit?!” We have heard it time and time again and are sure you have had that thought once or twice, especially if you are contemplating filing. The truth is bankruptcy actually acts as a repair for your credit.

Think about it, if you are having thoughts of filing bankruptcy, you probably aren’t in the best of financial situations at the moment anyways. The piling of bills and never ending debt aren’t looking so good on your credit report. If you’re trying to repair your credit score without bankruptcy, it may be like trying to swim up a white water rapid. No matter how hard you swim, the waves are too strong and will only push you back.

All of your bills and large amount of debt will keep pushing you back from achieving the credit score you want. Instead of fighting the rapids, you should think of exiting the river and walking up the stream.

With Bankruptcy, you discharge all of your stressful debt and are given a fresh start. Yes, your credit score will decrease when you initially file, but think of how easy it will be to reestablish an excellent credit score without having all of the baggage on you. You can walk up that river with ease; nothing will push or hold you back.

You can achieve that credit score you once had or always dreamed of once you rid yourself of everything that is holding you back and keeping you from what you financially desire.

Bankruptcy Law: We Practice What We Teach!

Doan Law Firm’s experience and expertise in Bankruptcy law was called upon by LawReviewCle to lead a Chapter 7 and Chapter 13 CLE (Continuing Legal Education) workshops in Riverside and Santa Ana. The nonprofit organization seeks and selects attorneys who represent the best in their area of practice. Once selected, they are asked to train other attorneys in their field to provide information on advanced legal practice and update their credentials.

In April, Doan Law Firm managing attorney, Anthony Vigil, conducted a workshop for 30 legal professionals on both Chapter 7 and Chapter 13 at the historic Mission Inn in Riverside, California. His presentation included a step-by-step workshop oriented class on filling out Bankruptcy Petition forms and local Chapter 13 Plan forms in addition to nuances that arise from practicing in the Central Division of California. Later this month Mr. Vigil will conduct a similar workshop in Anaheim.

Vigil’s outstanding success as a bankruptcy attorney has furthered Doan Law Firm’s passion to help others and their ambition to maintain the highest level of excellence in the field of bankruptcy law.  Vigil’s donation of time to the CLE program aligns well with the Doan Difference™. Contest Winners: They “like” our Facebook pages, but they love their new IPads!

Throughout the months of February and March we hosted a contest for our Facebook pages. The participants were simply asked to watch either our bankruptcy or tax services video, fill out the contact form, and like our facebook page. Although all of our contestants won free education on bankruptcy and tax services, there could only be two grand prize winners. Kyle O’Kelly and Beatriz Ramirez both won 16GB Apple Ipads! Congratulations!

Bankruptcy and the Government Shut Down

What happens if you’re ready to file Bankruptcy and the Government shuts down? Don’t worry; Bankruptcy cases are filed 24 hours a day, seven days a week, 365 days a year. Thanks to the Bankruptcy Court’s electronic case filing system, not even a shutdown would slow down the filing process. Theoretically, that is. The Bankruptcy Court system uses something called CM/ECF which stands for Case Management / Electronic Case Filing. CM/ECF is a fully computerized case filing and record management system. But in the case of a shutdown, what if the system were to go down? There is no way to say with absolute certainty, but it is very likely that the filing process would progress without a glitch.

Additionally, the Courts recently stated that If Congress is unable to agree on the continued funding of government, the Judiciary is prepared to use non-appropriated fees to keep the courts running for up to two weeks.

So, the next question may be, “What happens if the government files for bankruptcy?” Hmmm, now that’s something we hope never to have to answer.

Debtpidemic [det-pi-dem-ik] – noun a rapid spread or increase in the occurrence of toxic debt, affecting individuals, corporations, as well as local, state and national governments:  Doan Law Firm has officially declared a debtpidemic.

Our collective debt load has reached such a level that we need a new word to describe it.  We propose “debtpidemic”.  The pivotal concept behind this newly coined word is that an epidemic changes the lives of everyone in a society whether they are infected or not.  At this point in our history, national and personal debt is taking a heavy toll on our families, friends and loved ones.

Imagine if the bubonic plague swept our great land.  It would command our instant attention.  Each of us would take the utmost precautions.  We’d be hand-washing, antidote-seeking, near-hysteria fools.  We would implicitly understand the severity of the situation, the stakes are high, it’s life or death.

We’re in the same predicament now, it’s just a different plague.  Our government has emptied its arsenal; stimulus, bailouts and special programs.  At home we have pounded the pavement for work, tightened our belts and then tightened them some more, yet the debtpidemic rages on.

What is the antidote?  The first step is to stop the debtpidemic at home.  Take a good, hard, objective look at your personal financial situation.  Do you wonder how to keep the hamster wheel spinning?  Do you engage in creative accounting to get everyone, or almost everyone, paid?  Most importantly, does your financial situation keep you up at night?
