After Your Telephonic Petition Review

This video explains the process once you’ve finished reviewing your case with our attorney in a telephonic review.

Once you get off the phone after your petition review, you’re so close to filing with the bankruptcy court it’s scary. Now that you’ve gone over every fine detail of your financial life on the phone you are ready for your signing appointment. So the next step is to attend that appointment. Your signing appointment will be short and sweet. Once the petition is signed, it’s filed with the court. Our office files every Monday and one final time at the end of the month. About a week after your case is filed you’ll receive a packet from DLF in the mail with important information. Keep this packet handy and secure. Guard it with your life. Ok maybe, not with your life, but put some effort into it.

The packet will contain your filing date and case number. The filing date of your petition is the day your automatic stay came into effect. Creditors are not permitted to contact you in any way after this date. Contact our office immediately a creditor continues to call you or takes any collection action like garnishing your paycheck or taking money out of your bank account. That’s against the law and it needs to stop. We’re here to make sure that happens. Let’s talk about 2 other essential items you’ll find in your packet, your hearing date and information on your second credit counseling course. Mark your hearing date, called a 341, on your calendar and move heaven and earth to attend. Let us know the minute you think there might be a problem. Everyone is required to attend their scheduled hearing. We have another video on this topic and a simulated hearing you can view to further calm any fears. You can take your second credit counseling course anytime. Log into Hummingbird like you did the first time and select the “After Bankruptcy” tab. Settle in with your popcorn for the next 90 minutes of gripping video.

Stay awake because there will be a test. I’m not kidding. You don’t need 100%, but enough to show you paid attention so don’t have Terminator 3 playing in the background. Write your control number on the paperwork provided and send the hard copy to the San Clemente office – no faxing or scanning. We need the original so use US Mail, carrier pigeons or drop it off at the San Clemente office. On a final note, remember that the automatic stay does not allow creditors to contact you? The automatic stay operates as a brick wall between you and your creditors and that brick wall blocks creditors you may still want to pay like your mortgage and car. The court is serious about the brick wall and creditors cannot accept automatic payments, online payments, or even over the phone payments. They can’t even send regular statements.

For any asset you need to continue to pay, send a physical check to the lender. Just like the old days, be sure to put your account number on the check and take a photocopy for your records. Plan on doing this for 6 or 7 months as you move through the bankruptcy process. After your bankruptcy discharge, the brick wall will fall and you will again receive direct communication from the creditors you kept through the bankruptcy.
