Bankruptcy…a ‘Patriotic’ Solution? Part 3: BANKRUPTCY’S BIBLICAL ROOTS

“At the end of every seven years you shall grant a release of debts. And this is the form of the release: Every creditor who has lent anything to his neighbor shall release it; he shall not require it of his neighbor or his brother, because it is called the LORD’s release” (Deuteronomy 15:1-2).

The Bible refers to debt as a type of bondage: “…the borrower is a slave to the lender” (Proverbs 22:7). The Bible also declares, at the end of the sixth year: “…in the seventh year you shall let [your Hebrew slave] go free from you. And when you send him away free from you, you shall not let him go away empty-handed; but you shall supply him liberally from your flock…” (Deuteronomy 15:12- 14).

Current bankruptcy laws, like the Biblical provision, allow debtors to keep certain property when they file bankruptcy. This helps provide a fresh start and discourages going back into debt-bondage, allowing them to become more productive members of our community and meaningful contributors to our economy.

Highest Bankruptcy Filings in More than 5 Years

In Orange County the first quarter of the year ended with a 65 month high in Bankruptcy filings.1,881 individuals and businesses filed for Bankruptcy Protection making it the highest one-month total since the Bankruptcy law was changed in 2005. This represented a 10.1% year over year increase and the highest number of Bankruptcy filings for the month in 11 years as reported by the U.S. Federal Bankruptcy Court.

Although nationally, the increase of Bankruptcy filings seems to be slowing, the bottom line is that it continues to increase. The economic recovery here in Orange County, Los Angeles, and the Inland Empire will remain extremely slow until unemployment improves and the housing market gets upward traction…neither of which will likely happen soon. Until then, Chapter 7, Chapter 11, and Chapter 13 Bankruptcy will remain among the most viable means for individual economic recovery. For many, Bankruptcy is an excellent wealth management strategy. A Real DLF Client

This is the start of series of giving you a glimpse into the lives of real DLF clients.  These are not actors, but real people facing real life and receiving real help from DLF and the US Bankruptcy Court. *

Today I’ll introduce Judy.  She’s a single woman that’s been in the hospitality industry her entire life and she’s now in her 50s.  Judy’s been running restaurants and cafes inside hotels in Southern California for over 20 years, but she hails from South Carolina, where her aging mother still lives.  It’s been a rough couple of years for her as the economy has seen many people cutting back on their hotel stays and the attached food service.   Although she works 60+ hours in the high season, with little work available in the low season, she’s not able to weather it and has incurred debt.

Judy recently received the call we all dread.  Her mother in South Carolina is failing in mind and body.  Judy is desperately needed back home to care for her mother.  She’s more than happy to go, but a look at her finances revealed what Judy already knew, she needs to keep the hamster wheel turning to have a chance of servicing the credit card debt she’s accumulated.  Judy can’t miss more than a few days of work or the house of cards will collapse.

What Judy discovered in our consultation was that she could discharge her credit card debt in a Chapter 7 bankruptcy.  Despite her long hours at work, when we look at her income over the last 6 months, she’s below the median in the state of California and can qualify for Chapter 7 on that basis.  Her debt is solely dischargeable credit card debt so she will receive a complete fresh start that will enable her to move back to South Carolina, find a new job and care for her mother.

I used an inexperienced phlebotomist and looked like I’d lost an arm wrestling competition to the Hulk.

I used an inexperienced mechanic and spent quality time on the side of the freeway at high noon.

I used an inexperienced Algebra tutor and raised welts on my head while banging it on the desk.

I used an inexperienced dentist and now I’m having many fillings replaced with a few bonus root canals.

I used an inexperienced hairdresser and you don’t want to hear about that.  I’ll give you one word.  Green.  Make that two.  Short and Green.  I looked like the victor of the aforementioned arm wrestling match.

Bruises heal, hair grows, cars get fixed and so do teeth, but financial calamity can follow you for decades.  Literally decades.

I hear horror stories from clients who used inexperienced bankruptcy attorneys.  One was even told a by the judge to get a “real attorney”.  We want to help, but we have to start at square one.  Just like a contractor won’t come into the middle of a building project and try to reinforce the foundation, straighten the walls and jerry-rig the electrical, a good bankruptcy attorney won’t come in after a hack and try to fix a botched bankruptcy filing.  We start again.  Get it done right the first time, take your fresh start and fly (with an experienced pilot of course).
